ICON•S Mundo, the 2021 conference of the International Society of Public Law sought to make public law accessible to scholars of all types, regardless of area of interest, methodological approach, academic position, or geographic location.

Guarini Global Law & Tech Executive Director Thomas Streinz joined Tomer Shadmy and Tilen Cuk on a panel chaired by Tamar Megiddo to discuss Global Platform Power, Algorithmic Governance, and Public Law Theory.

Global information platforms (eg Facebook) and algorithmic systems for financial market regulation raise new questions about market, regulatory, technological, and political power and the various private and public legal technologies constituting, shaping, and potentially constraining such power. Our panel will offer novel perspectives on questions such as: Do public law theories provide a useful framework to analyze these transformations? Are shifts towards algorithmic governance and private control over information posing insurmountable challenges? Can we apply established public law principles (such as transparency requirements) or do we need to find new ways of confronting global platform power? How can public market regulators obtain the data necessary to fulfill their regulatory functions? Our panel will discuss these questions (and more) in an open and discursive manner with plenty of time for discussion with the audience.
